Booking Agreement

Ever Booking Agreement
Deposits are required for online bookings to reserve a date. Deposits and payments made are non-refundable, except as follows: customers who book direct on onetimessquare.com have up to 24 hours after booking to cancel for any reason and receive a full refund with no fees. Otherwise, cancellation or rescheduling fees may apply. If you need to reschedule a booked date, purchases are good for one year from the date of the original booking. No shows will result in a full forfeiture of all payments made.
Deposits & Payments
A non-refundable deposit, as stated in this agreement, is required at the time of signing and will be applied toward the total cost of the event. All deposits and payments made to Ever are non-refundable, except as expressly stated herein.
Full pre-payment (100%) based on the contracted minimum guarantee or the final guest guarantee, whichever is greater, is required 30-days prior to the event date. Failure to remit full payment may result in cancellation of the event, with Client remaining responsible for full payment as outlined in the applicable cancellation fees.
For online bookings, full non-refundable payment is required to reserve the date. Refunds may only be issued if the reservation is canceled within twenty-four (24) hours of booking.
Rescheduling & Cancellations
- Client may reschedule the reserved date without penalty if notice is provided a minimum of ten (10) days prior to the event date. Any rescheduling within nine (9) days of the event will incur a $100 rescheduling fee or forfeiture of the deposit.
- Specialty dates and holidays require a minimum of fifteen (15) days' notice for rescheduling. Any rescheduling within fifteen (15) days will incur a $300 rescheduling fee or forfeiture of the deposit.
- All rescheduled dates are subject to availability and may be subject to additional costs based on the new date and time selected. If Client cancels or reschedules, all payments made may be applied toward a future event for up to one (1) year from the original purchase date. No-shows will result in forfeiture of all payments made to Ever.
Publicity & Event Images
Ever has the right to include Client among its client list for publicity and marketing purposes. Ever also reserves the right to take photographic and/or video images of the event (collectively, the “Images”) and to use such Images worldwide, in perpetuity, for advertising, trade, and/or promotional purposes in any and all media now known or hereafter devised, without notification or compensation.
Administrative Fee
An administrative fee equal to twenty percent (20%) of the total charges for all items, including but not limited to labor, room rental, audiovisual, and miscellaneous charges, will be added to the final bill. This administrative fee is subject to sales tax. The administrative fee is not a gratuity, is not distributed to service staff, and is retained by Ever to cover operating expenses.
Taxes
All prices are subject to applicable New York City and New York State sales taxes. Any additional taxes required under New York State law will be charged accordingly.
Function Space & Event Modifications
Ever reserves the right to reassign function space if the originally designated space becomes unavailable or inappropriate, in Ever's sole discretion, including but not limited to issues related to inclement weather, capacity, or operational needs. Ever also reserves the right to make reasonable substitutions to items or commodities due to increased costs or unavailability.
Special Requests
All special requests for decor, florals and add-on's are subject to availability and may incur additional fees. For example, for florals, exact color matches are not guaranteed.
